LGBT Immigrants Slam Obama's Plan: 'He's Not In Support Of Us'
WASHINGTON — Undocumented LGBT immigrants are criticizing President Barack Obama for excluding them from his immigration plan, even as they are happy to see members of their families and communities freed from the fear of deportation.

The president announced last week that he would grant short-term deferred action and working rights to parents of U.S. citizens and legal permanent residents who themselves have been in the country for at least five years. But lesbian, gay, bisexual and transgender immigrants say that the plan doesn’t equally value their family relationships. Undocumented LGBT immigrants may be less likely to have U.S. citizen children due to marriage and adoption laws, while they may have critical ties with U.S. citizen nieces and nephews.

LGBT immigrants also have a compelling need for deportation relief, advocates argue, for they often face homophobia and violence in their home countries and a high risk of victimization in U.S. detention facilities.

Last week, a coalition of LGBT and civil rights organizations urged the president to make length of residency in the United States an alternative criteria for relief, in addition to parenthood. Legal experts contend that Obama had adequate legal precedent to extend deferred action to LGBT immigrants, if he chose to do so.

Alejandro, who lives in Chicago and is not using his last name for fear of job loss, is one of the roughly 267,000 undocumented LGBT-identified adults living in the United States. He came to the U.S. from Mexico about 15 years ago and is not eligible for deferred action under Obama’s plan because he does not have children. He told The Huffington Post that he was glad many people would be helped, but “very disappointed” that so many LGBT immigrants aren’t covered, especially given that Obama has “said he is friendly with the LGBT community.”

“A lot of us, we have been in support of his agenda, and now we know he’s not in support of us,” Alejandro said.

Jonathan Perez, cofounder of the Immigrant Youth Coalition, is a 27-year-old undocumented asylum seeker who came to the U.S. from Colombia as a child and identifies as queer. He said Obama’s action re-enforces the idea that there are “good” immigrants — parents and students — and “bad” immigrants. “The good immigrants get something, and then everyone else is going to be criminalized. That’s how we’re taking this. It’s not even a victory,” he said.

The executive action “will not reach most LGBT people who need it,” said Mara Keisling, executive director of the National Center for Transgender Equality, in a statement last week. “Though the President has been a champion of LGBT equality, he still must do more to protect LGBT immigrants.”

The backlash shows how the decades-old practice of building immigration reform around traditional family units is complicated in 2014. On one hand, Republicans are already threatening to stonewall the president’s attempt to extend deferred action to immigrant parents, contending such action is unconstitutional. On the other, limiting relief to such a narrow group of people fails to take into account the full demographics of immigration populations, advocates say.

It also leaves a vulnerable population still looking for help. Last year, the Center for American Progress found that LGBT immigrants are 15 times more likely to be sexually assaulted in immigration detention facilities than other immigrants.

“Transgender women in particular at at extreme risk because ICE [Immigration and Customs Enforcement] houses them in men’s jails,” said Harper Jean Tobin, director of policy at the National Center for Transgender Equality.

LGBT immigrants are often seeking amnesty to escape discrimination and persecution in their home countries. Diego Ortiz, communications director for Immigration Equality, told Bloomberg that he has seen a large increase in LGBT people seeking asylum from countries where homophobia is rampant, like Uganda and Russia.

In 2011, Perez spent five days in prison and 10 days in a detention facility, an experience that he said continues to traumatize him. As a LGBT person, he said, he has become accustomed to finding ways to “maneuver … around the homophobia.” But in detention, “there’s no way out. … I almost felt like I got thrown back into the closet,” he said, because he didn’t feel safe revealing his sexual orientation.

Obama draws his legal authority to take executive action on immigration in part from a longstanding principle known as “prosecutorial discretion.” Basically, there aren’t enough government resources to tackle every single crime, so the government has to choose which people pose the greatest danger to society. Under this precedent, the president has said that if undocumented immigrants meet specific criteria, they will not be a priority for deportation.

Greg Chen, director of advocacy at the American Immigration Lawyers Association, said the president has the authority to grant deferred action for individuals who meet certain criteria, as long as the Department of Homeland Security isn’t prioritizing their deportation because of safety concerns.

“That set of criteria could very well encompass LGBT individuals,” Chen said, if “there’s an interest in the government to focus on that population.” The coalition of LGBT groups contends that the threat of discrimination is a compelling reason to grant relief.

Philip Wolgin, a senior policy analyst on the immigration policy team at CAP, said, “We strongly believe the legal precedent does support granting deferred action to groups of people.” In the past, executive action has been used, for example, to protect Cubans escaping communism.

CAP notes in a blog post that the president’s action is expected to have some positive effects on LGBT immigrants — by protecting LGBT immigrants married to U.S. citizens from long separations and reducing deportation for illegal re-entry. But for now, undocumented LGBT immigrants without children continue to face the risk of deportation.

Ramon Madera, who is a gay undocumented immigrant, works with the immigration committee of PICO, a faith-based community organizing network. The 36-year-old said that he too is happy for all the people who will qualify under Obama’s plan, including his sister. But he said that when he heard the announcement, he was also ”confused and disappointed.”

“There’s no way I want to go back,” he said of returning to Mexico. “I know one thing: I’m afraid to go back to my country.”

Bernardo Bertolluci’s striking 1970 feature about an Italian police functionary — played by Jean-Louis Trintignant — tasked by fascists to assassinate his former teacher. A major influence on films and filmmakers since, including The Godfather, it receives a sterling restoration here with extras including an hour-long documentary, trailers, and a booklet.

Altanta's Fire Chief Kelvin Cochran Suspended After Self-Publishing An Anti-Gay Book
ATLANTA (AP) — Atlanta’s fire chief has been suspended after city officials say he violated policy by self-publishing a book that describes homosexuality as a “perversion.”

Atlanta Mayor Kasim Reed says in a statement Monday that Kelvin Cochran will be suspended for a month without pay and will be required to complete sensitivity training. Reed says he was “deeply disturbed” after learning about the book on Friday and will not tolerate discrimination within his administration.

The Atlanta Journal-Constitution reports that the book titled “Who Told You That You Are Naked?” identifies Cochran as a devout Christian and as the city’s fire chief (http:// bit.ly/1y6v1mf). City councilmember Alex Wan, who is openly gay, says Reed should investigate whether Cochran’s views have affected LGBT employees.

Reed’s office says Cochran was not made available for comment.

Mike Nichols Saved Our Lives!
Mike was a mensch. He was the wittiest man I ever broke bread with, and he was a quiet philanthropist who saved lives while he was influencing “the American century.” He improved the quality of life of countless men and women, many of whom died, but many of whom, gratefully, live on.

1991 was a dark time. The gay community, the arts community, was decimated. We needed comfort, we needed hope, and we needed a beautiful space to come together and celebrate life as we struggled to maintain it.

The brilliant tributes to Mike that have flooded the media over the last few days capture the extraordinary gifts his talents brought to film, theater, television, comedy and the American consciousness as it has evolved over the last 60 years. What hasn’t been said is that Mike not only changed lives; he saved them. Back then, in 1991, when Cynthia “Cy” O’Neal told Mike about her idea for a pragmatic spiritual crisis center for people affected by AIDS, Mike immediately said, “I’ve been looking for something to do, and this is it.” Cy’s vision needed Mike’s magic touch — his ability to pick up the phone and call just about anybody. Together they created Friends in Deed: The Crisis Center for Life-Threatening Illness.

Mike was the founding chairman. For 13 years he headed up an eclectic board of creative and powerful people who wanted to serve with Mike because anything done with Mike was as much fun as it was work. Board meetings could be tough, but they were also illuminated by his wit and contagious good will. We had a blast creating brilliant fundraisers: Picture Mike and Elaine May performing some of their classic routines with Simon & Garfunkel (reunited for the first time in over a decade) as their opening act in an intimate Broadway theater; Whoopi Goldberg recreating the one-woman show that Mike had directed for her (after typically recognizing an unusual talent); Mike and Steve Martin performing in a loft for a fortunate few one night; and so many other brilliant evenings that only Mike could have made happen — and he did, for Friends in Deed, for the clients. Mike was not only a force when it came to fundraising; he was a part of the community. Mike attended many a Tuesday-night Big Group. I can picture Mike’s stunning wife, Diane Sawyer, singing Christmas carols by the piano at the annual holiday parties that were lavishly catered with food that they had quietly sent ahead. Clients were not “other”; they were friends.

A former client wrote to me last week, “I probably wouldn’t be where I am today if it weren’t for Mike Nichols and Cy O’Neal…and everyone who has made Friends In Deed what it has become….”

The work continues. Mike became Chairman Emeritus, and Hamilton South and I succeeded him as Chairman (it took two of us to fill his shoes), and today Andy Cohen heads up a vibrant board that supports Cy and the wonderful staff and volunteers. Mike’s deed still provides comfort and safety.

Father Can’t Cope With Deceased Trans Daughter, Presents Her As A Man At Funeral

Screen Shot 2014-11-24 at 3.52.49 PMFriends of Jennifer Gable were astonished when they attended her open casket funeral to discover her dressed as a man, complete with short haircut and suit.

Her identity as a trans woman was completely erased and replaced with her former self, the version of her that her father was more comfortable with, reports Miami Herald.

Programs featured her birth name “Geoffrey Gable,” and gave a briefing of her life that completely left out her transition. It read:

Geoffrey Charles Gable, 32, Boise, passed away suddenly on October 9, 2014 while at his job at Wells Fargo Bank.

He was born in Twin Falls on January 27, 1982 to Anthony Clark Gable and Lori Ann Walton.

Geoff and his brother, Steven, were raised from toddlers by their maternal grandparents, George and Joan Walton.

He attended Morningside Elementary School, O’Leary Junior High and graduated from Twin Falls High School in the year 2000.

He was married to Ann Arthurs in 2005 in Hawaii. They were later divorced.

Geoff grew up as a member of the Twin Falls First Christian Church, where he was baptized in 1996.

Meghan Stabler, a board member of Human Rights Campaign and member of HRC’s National Business Council, had contact with Jennifer a few years back. She had this to say of the ordeal:

“No mention of the woman she knew she was and had lived as for several years. Just erosion of her identity and an old photograph of how the father perceived her to be.

She had done what she needed to do legally to be seen as her authentic self. Her father erased her identity either though ignorance or arrogance.”

She added that this injustice shows the importance of keeping an updated will.

A grand jury has decided not to indict Darren Wilson, the Ferguson police officer who shot and killed Michael Brown back on August 9. 

Earlier today, CNN reported on what would happen to Wilson should the jury not move forward with indictment charges:

If the grand jury clears him of wrongdoing and Wilson wants to remain on the job, he could put up a fight. The police union would back him, said Paul Callan, a CNN legal analyst and former New York prosecutor.

“In the end, he has certain due process rights under Missouri law, and they can’t just summarily fire him because he’s unpopular,” Callan said. “They will have to prove that he violated some aspect of his employment contract as a police officer, or civil service regulations. Otherwise, he will have a very good lawsuit.”

Still, most people believe Wilson will never again wear a badge.

“If I’m the mayor of Ferguson, believe me, you would want that cop out because you know that he will be controversial,” Callan said. “He will be distrusted by the citizenry and maybe subjected to abuse when he’s out on the street. It’s just going to be nothing but trouble. They’re going to find a way to get him out. They may try to buy him out.”
