HRC Mourns Yahira Nesby, Black Trans Woman Killed in Brooklyn

HRC is deeply saddened to learn of the death of Yahira Nesby, a 33-year-old Black transgender woman who was killed in Brooklyn, New York in an act of gun violence on December 19. The New York City Anti-Violence Project worked with Nesby’s close friends to confirm her identity.

Nesby’s death is at least the 25th known transgender or gender non-conforming person killed this year. She was a loved member of the New York ball scene, and a member of the House of Chanel. She was from Charlotte, North Carolina. She was a religious woman, who shared videos and powerful words of faith on her social media profiles.

Her friends and family commented on social media about her death, calling Nesby “a good spirit,” “genuinely good people,” and said “Every time [Nesby was] around [she] put a smile on my face and others.”

Of the known transgender and gender non-conforming people killed this year, 19, including Nesby, have died from gun violence. Of the more than 150 known victims of anti-transgender violence from 2013 to present, approximately two-thirds of those killed were victims of gun violence.

“We must work collaboratively to find new ways to combat this epidemic that continues to target transgender people, especially trans women of color,” recently tweeted HRC President Alphonso David about this epidemic of violence. “HRC is committed to working with grassroots activists to push for change from political leaders & law enforcement.”

In November, ahead of Transgender Day of Remembrance, HRC Foundation released “A National Epidemic: Fatal Anti-Transgender Violence in America in 2019,” a heartbreaking report honoring the trans people killed and detailing the contributing and motivating factors that lead to this tragic violence. 

These victims are not just numbers or headlines. They were real people worthy of dignity and respect, of life and love. 

There are currently very few explicit legal protections for transgender or gender-expansive people. While transgender people in New York are explicitly protected across many aspects of daily life, including housing and employment, and are covered under the state’s hate crimes legislation — many continue to face barriers in their daily lives. Nationally, despite some marginal gains in state and local policies that support and affirm transgender people, recent years have been marked by anti-LGBTQ attacks at all levels of government. We must demand better from our elected officials and reject harmful anti-transgender legislation appearing at the local, state and federal levels because it is clear that fatal violence disproportionately affects transgender women of color. The intersections of racism, transphobia, sexism, biphobia and homophobia conspire to deprive them of necessities to live and thrive.

HRC will continue to hold the Trump-Pence administration and all elected officials who fuel the flames of hate accountable at the ballot box. 

This epidemic of violence that disproportionately targets transgender people of color — particularly Black transgender women — must cease.

6 homophobes who were busted on Grindr

What is it with homophobes and Grindr? This week, an antigay preacher from Missouri was busted trying to buy sex off Grindr… and paying for it with an Arby’s gift card.

57-year-old Barry Cole Poyner of Kirksville, Missouri is, er, was an elder at the Kirksville Church of Christ, as well as a professor of communications at Truman State University, before news of his gay sex scandal went national.

He was slapped with a class B misdemeanor count of patronizing prostitution after cops received a tip that he’d been “harassing male Truman students for sexual contact as well as offering to pay for items for sexual favors by using the app Grindr” then set up a fake profile to catch him in the act.

It didn’t take long for Poyner, using the handle “DILF,” to reach out to an undercover officer, saying he “would love to have a sugar daddy relationship” and offering to buy him a tank of gas and an Arby’s gift card in exchange for sex.

When police eventually confronted him, Poyner said he was only “trying to help” and that he had no intentions of “doing anything with a minor.” If convicted, he faces up to six months in prison and a fine of up to $1,000.

Bill Sanderson

In July 2019, the Republican lawmaker was accused of keeping a secret Grindr profile while simultaneously pushing several pieces of antigay legislation through the Tennessee House of Representatives. After screenshots of alleged chats between Sanderson and other men leaked online, the lawmaker, who happens to have a gay son, insisted he was being framed then said he was resigning from office, though he maintained his resignation had nothing to do with the gay sex scandal.

Man Gets 17 Years in Prison for Burning Church’s LGBTQ Pride Flag

An Iowa man has been sentenced to 17 years in prison for tearing down and burning an LGBTQ Pride flag from Ames United Church of Christ.

The BBC reports: “The incident occurred around midnight on 11 June in downtown Ames, Iowa. Police say the crime spree began at Dangerous Curves, a strip club, when police were called because a man was making threats. By the time they arrived, he had already been kicked out by bar staff. After leaving the club, Martinez then travelled to the church and ripped down its flag. He then returned to the strip club where he used lighter fluid to burn the flag in the street. He also threatened to burn down the bar.”

Martinez told local news station KCCI after being arrested that he was “guilty as charged,”did it because he “opposed homosexuality,” and added: “It was an honour to do that. It’s a blessing from the Lord. I burned down their pride, plain and simple.”

The Ames Tribune reports: “Adolfo Martinez, 30, was convicted by a jury in November of a hate crime, third-degree harassment and being a habitual offender, which is associated with previous reckless use of fire crimes. He was sentenced Wednesday in Story County District Court, in Nevada. All three crimes were to be served concurrent as the habitual offender charge carries a 15 year sentence and hate crime two years. Martinez is not eligible for parole until the mandatory minimum of three years is met. He is the first person to be convicted of a hate crime in Story County, Story County Attorney Jessica Reynolds said.”
