HRC: Trump Solicitor General Doubles Down on Bigotry at SCOTUS in Attempt to Erase Trans People

HRC responded to news that Trump’s Solicitor General, Noel Francisco, argued to the Supreme Court that civil rights protections banning sex discrimination in the workplace do not cover transgender employees, just days after the New York Times revealed the Trump-Pence White House is attempting to redefine “sex” across the federal government in order to justify their decision to refuse to protect transgender people under federal civil rights law.

“Time and time again, federal circuit courts have ruled that discriminating against an individual based on their gender identity is form of sex discrimination — which is prohibited under a wide range of federal laws including Title VII of the Civil Rights Act of 1964,” said HRC Legal Director Sarah Warbelow. “The Trump-Pence Administration is continuing down a destructive path that will put transgender people at further risk of discrimination and violence. For the Department of Justice to conveniently ignore significant legal precedent is deeply disturbing.”

The case before the Court involves a transgender woman who was fired by a funeral home when she informed her supervisor that she is transgender. Francisco’s filing with the Supreme Court is at odds with numerous circuit court decisions and the Equal Employment Opportunity Commission’s interpretation of federal law.

On Sunday, the New York Times reported the U.S. Department of Health and Human Services (HHS) is planning to release regulations narrowly defining “sex” in an anti-transgender way that guts enforcement of existing civil rights protections for LGBTQ people. The Administration’s plans are in direct conflict with a growing trend in federal court decisions affirming that sexual orientation and gender identity are covered under our nation’s civil rights laws which prohibit discrimination based on “sex.” This is the latest effort in a consistent, multi-pronged campaign by the Trump-Pence White House over the past two years to undermine the rights and welfare of LGBTQ people.

The Human Rights Campaign is calling on the American people to send a clear message to the Trump-Pence White House in November by voting for candidates that fully support LGBTQ rights and will work to pass the Equality Act.

The Equality Act would finally add clear, comprehensive non-discrimination protections for LGBTQ people to our nation’s civil rights laws. In addition to having bipartisan support in Congress with 246 cosponsors, 117 major corporations have also joined HRC’s Business Coalition for the Equality Act. Discrimination is a real and persistent problem for far too many LGBTQ Americans. HRC polling has found that nearly two-thirds of self-identified LGBTQ Americans report experiencing discrimination.

Justice Department Files Brief Arguing That Businesses Can Fire Workers Because They are Transgender

The Trump administration on Wednesday filed a brief arguing that businesses have the right to fire transgender workers

Bloomberg reports: “Solicitor General Noel Francisco told the high court that a civil rights law banning sex discrimination on the job doesn’t cover transgender bias. That approach already has created a rift within the Trump administration, contradicting the Equal Employment Opportunity Commission’s view of the law it’s tasked with enforcing. A Michigan funeral home wants the high court to overturn a U.S. Court of Appeals for the Sixth Circuit decision finding that the company violated federal workplace discrimination law when it fired Aimee Stephens, a transgender worker. The EEOC successfully sued on behalf of Stephens in that case, but the Justice Department has the sole authority to represent the government before the Supreme Court. Francisco told the high court that the Sixth Circuit got the case wrong.”

The New York Times published a report on Sunday that his administration plans to define transgender people out of existence by defining gender by genitalia at birth.

Trump commented on the report Monday evening: “We’re looking at it. We have a lot of different concepts right now. They have a lot of different things happening with respect to transgender right now. You know that as well as I do, and we’re looking at it very seriously. I’m protecting everybody. You know what I’m doing? I’m protecting everybody. I want to protect our country.”

The plans are the latest, and most draconian, of a series of efforts the Trump administration has been making to remove and restrict the rights of transgender individuals, including military servicefederal prison rightshealth careschoolsthe CDCthe judiciary, and more.

According to the memo seen by the NYT, the HHS proposes that “Sex means a person’s status as male or female based on immutable biological traits identifiable by or before birth. The sex listed on a person’s birth certificate, as originally issued, shall constitute definitive proof of a person’s sex unless rebutted by reliable genetic evidence.”

Right Wing Watch reports: ‘The effort is being led by Roger Severino, who has taken the anti-LGBT agenda of his former employer, the Heritage Foundation, into the Trump administration as director of the civil rights division at HHS. When he was named to that position, a dozen U.S. senators objected, citing Severino’s “long history of making bigoted statements toward lesbian, gay, bisexual, and transgender people and attacking women’s access to health care services and reproductive rights.” One of Severino’s former colleagues at the Heritage Foundation, Ryan Anderson, is at the forefront of the Religious Right’s anti-trans crusade. Anderson’s latest book is “When Harry Became Sally: Responding to the Transgender Moment.” Anderson argues that gender cannot be severed from biological sex, and that “taking our sexual embodiment seriously in public policy is not discriminatory.”’

HRC announced the hires of Meghan Kissell as the new director of Project One America and Denise Donnell as the state director for the Human Rights Campaign’s office in Arkansas.

“As a native-born Arkansan, HRC’s work to expand LGBTQ equality in the South is personal, and I couldn’t be happier to have Meghan leading this work as the director of Project One America. We’re also pleased to welcome Denise Donnell back to HRC as our new state director in Arkansas,” said HRC President Chad Griffin. “When HRC opened offices in these three states in 2014, we knew this would be a long-term investment in tangibly improving the lives of LGBTQ Southerners. Now, after HRC has worked to pass several non-discrimination ordinances in Mississippi and Alabama, to improve healthcare conditions for LGBTQ Southerners and to elect pro-equality candidates up and down the ballot, we are excited to have Meghan and Denise help lead this work and build on our hard-fought progress.”

Prior to joining HRC, Meghan worked for the Conservation Lands Foundation to help lead local and national campaigns resulting in the successful protection of more than 5 million acres of public land. She worked in support of the original passage of the Affordable Care Act while at the American Diabetes Association and advocated for reproductive rights and legislation combating violence against women.

As the Field Director for the American Association of University Women, she supported volunteer around the country work on GOTV efforts. Meghan also provided strategic council and trained non-profit organizations on developing targeted social impact strategies designed to engage elected officials and the media. Meghan has a Master’s degree in Social Work with a focus on community organizing from Howard University in Washington, D.C. and a Bachelor’s degree in Political Science from Allegheny College in Pennsylvania.

Mississippi-native Rev. Dr. Denise Donnell is an ordained elder in the Mississippi Conference of the United Methodist Church. She previously worked as an organizer with the Human Rights Campaign in both Mississippi and Arkansas. Having taken a year off to serve as the Chief Officer of Programs for Just Communities of Arkansas, Denise returns to HRC ready to continue building momentum for LGBTQ equality in Arkansas.

In 2014, HRC launched Project One America, an initiative geared towards advancing social, institutional and legal equality in Arkansas, Alabama and Mississippi. Project One America continues to work to advance equality for many LGBTQ Southerners who have no state level protections in housing, workplace, or public accommodations. The broadcast television premiere of the feature film debut by Gabriel Silverman & Fiona Dawson, TransMilitary, will take place on on Logo on November 15, following an official announcement from the network. The film is the first feature length project to receive completion funding from the GLAAD Media Institute.  GLAAD President & CEO Sarah Kate Ellis and Vice President of Programs Zeke Stokes serve as executive directors on the project, which premiered at South By Southwest earlier this year and won the audience award. SInce then, it has received rave reviews from audiences and critics alike, making stops and winning accolades at the AFI Documentary Film Festival, Frameline Film Festival, Florida Film Festival, and OutFest, among others.

Following the Emmy-nominated short film Transgender, at War and in LoveTransMilitary chronicles the lives of four American transgender troops defending their country’s freedom while fighting for their own, and the larger efforts to bring an end to the ban on transgender people serving openly in the U.S. military. Around 15,500 transgender people serve in the U.S. military, making them notably the largest transgender employer in the U.S. Unfortunately, they are forced to keep their gender identities veiled because military policies ban their participation. TransMilitary tells the story of four individuals (Senior Airman Logan Ireland, Corporal Laila Villanueva, Captain Jennifer Peace & First Lieutenant El Cook) defending their country’s freedom while fighting for their own.

They put their careers and their families’ livelihoods on the line by coming out as transgender to top brass officials in the Pentagon in hopes of attaining the equal right to serve. The ban was lifted in 2016, but with President Trump now trying to reinstate it, their futures remain in question.
