Toward a More Perfect Union: LGBTQ People and the Constitution

Toward a More Perfect Union: LGBTQ People and the Constitution

In response to the retirement of Supreme Court Justice Justice Anthony Kennedy, this week the Human Rights Campaign alongside the American Constitution Society hosted a legal symposium entitled, “Toward a More Perfect Union: LGBTQ People and the Constitution.” We were joined by some of the nation’s leading scholars, litigators and advocates who are working towards LGBTQ equality.

This event explored the constitutional connections between the LGBTQ community and the rights of equal protection and due process. Panelists engaged the current status of these constitutional safeguards and how they have impacted the LGBTQ community, as well as what is at stake for our community in the coming years.

LGBTQ people have always had a unique relationship with the law and with the Supreme Court.

Although the Supreme Court has been the source of some of our biggest victories over the last decade, our community is no stranger to loss. In the not so distant past, the Supreme Court ruled that laws criminalizing same-sex relationships were Constitutional. The court has also ruled that for profit employers should be given exemptions from generally applicable laws based on personal beliefs. Cases like this lay the groundwork for discrimination against a multitude of vulnerable communities — particularly ours.

As our panelists noted, marriage equality is settled law, but LGBTQ people still don’t have full equality. Too many LGBTQ people and families continue to be at risk for discrimination at work, when seeking housing or education — or even when entering a store or restaurant. In the coming years, the court will be asked to decide critical issues for LGBTQ people.

As we face these decisions, America needs a justice who has demonstrated a belief in the shared dignity, humanity and equal rights of LGBTQ people.

To get involved, text SAVE SCOTUS to 30644 and join our fight.

Tips for Making Classrooms More Inclusive as Students Head Back To School

Tips for Making Classrooms More Inclusive as Students Head Back To School

Post submitted by Kimmie Fink, Welcoming Schools Consultant

Back to School is a busy time for educators as they set up their students for success — laminating name tags, creating bulletin boards and writing lesson plans. They know that for many children, the first few days back to school can make or break their year. As educators sharpen their pencils, the HRC Foundation’s Welcoming Schools program is working to ensure that schools also take the time to make classrooms a welcoming place for all by cultivating an LGBTQ and gender-inclusive learning environment.

Don’t know where to start? HRC is here to help with these tips for developing LGBTQ and gender-inclusive classrooms and schools:

  1. Use inclusive language on all forms. Back to school means paperwork for families. Educators can make the process welcoming by ensuring all handbooks, forms and other communications are inclusive of all family structures and gender identities (e.g., using phrases such as “families and caring adults” in place of “moms and dads”).
  2. Stock your library shelves with diverse books. Make sure students have access to books that reflect not only their lives but also identities and perspectives outside their experiences. Challenge stereotypes by featuring a Welcoming Schools recommended book as a first day read-aloud.
  3. Create a welcoming bulletin board. We know displays are important features in every classroom, so why not switch out the apples and school buses for a display that shows diverse family structures and people of different races, gender expressions and abilities? Use slogans that encourage respect for all people. For an easy visual, print a Welcoming Schools safe school sign.
  4. Develop clear classroom and/or school agreements. Educators must ensure that bullying policies specifically name groups that are disproportionately bullied or harassed, and then make it clear to students that this means no put-downs about who someone is or who their family is. Preventing bias-based bullying starts on day one.
  5. Prepare for teachable moments. Educators can practice how to respond when they hear students say things like “That’s gay!” or “You act like a girl!” or “You’re not a real family because you don’t have a dad!” Be prepared to interrupt mean teasing about a child’s identity or their family.
  6. Model inclusive language. Instead of addressing classes as “boys and girls,” try using non-gendered words like “students,” “scholars,” or “friends” to be more inclusive of all identities.
  7. Group students according to something other than gender. There’s no need to have boys’ closets and girls’ cubbies. Divide children by number or line them up by birth month, color of clothing or alphabetically by name.
  8. Try a new lesson plan. Educators can give one of the Welcoming Schools lessons a try and start the year by teaching students how to be allies and learning about what makes each child special.
  9. Plan a family night. Hold an evening event to celebrate all families. Provide information for families and caring adults to help them talk with their children about LGBTQ and gender topics.

For more strategies and resources, visit the HRC Foundation Welcoming Schools website. Welcoming Schools is here to support you. HRC wishes you and the children in your care a wonderful 2018-19 school year.

Housed by the HRC Foundation, Welcoming Schools and Time to THRIVE are national programs designed to help LGBTQ youth succeed. Welcoming Schools is the nation’s premier professional development program providing LGBTQ and gender inclusive resources to schools to reduce bullying behavior and establish a positive school climate. Time to THRIVE is an annual national conference that brings together K-12 educators, counselors and other youth-serving professionals to build awareness and cultural competency to better support LGBTQ youth.

TODAY  — TRUMP, RENACCI AND DEWINE BRING DANGEROUS ANTI-LGBTQ ATTACKS TO OHIO: Donald Trump is scheduled to raise money for anti-LGBTQ U.S. Senate candidate Rep. Jim Renacci and Ohio gubernatorial candidate Mike DeWine in Columbus today. “Donald Trump, Jim Renacci and Mike DeWine have pushed anti-LGBTQ policies that are not only wrong, they are politically toxic in a state with more than 1.5 million Equality Voters,” said HRC State Manager Shawn Copeland. “Renacci opposes marriage equality, doesn’t support the Equality Act and has maintained a ‘zero’ score on HRC’s Congressional Scorecard for his entire career in the U.S. House. As Attorney General, DeWine defended the state’s marriage ban, stating that LGBTQ people did not deserve ‘protected-class status.’ That’s why HRC is mobilizing members and volunteers across Ohio to ensure voters stand up and reject Renacci, DeWine and their dangerous agenda.” More from HRC and PRIZM.

MASSACHUSETTS — VOTE YES ON PROP 3 TO PROTECT TRANS EQUALITY: HRC is working as part of the Freedom Massachusetts campaign to ensure Bay Staters turn out to vote “yes on 3” to uphold the Commonwealth’s non-discrimination law protecting transgender people from discrimination in public spaces, such as restaurants, stores, and doctors’ offices. In 2016, the Massachusetts legislature passed — with a bipartisan, supermajority vote — the historic non-discrimination protections for transgender people, and Republican Governor Charlie Baker signed the bill into law in July 2016. Shortly after it went into effect in October 2016, a small group of opponents gathered the minimum number of signatures required to place the law on the ballot for repeal this November. A “yes” vote on Question 3 keeps the current law in place. More from Washington Blade.

WITHOUT ADEQUATE ACCESS TO LIFESAVING CARE, TOO MANY TRANS PEOPLE TURN TO CROWDFUNDING: Larissa Shively-Vitt of Kansas is a proud transgender veteran who has been forced to crowdfund to pay for medically necessary care. Sadly, crowdfunding is rarely successful and no person should have to rely on it to access they care that they need. The Veterans Administration has the ability to change their regulations to provide for all veterans.  More from KCUR.
