HISTORIC: New Hampshire Approves Transgender Non-Discrimination Bill

HISTORIC: New Hampshire Approves Transgender Non-Discrimination Bill

Today the New Hampshire Senate passed HB 1319, legislation that would update the state’s laws prohibiting discrimination in employment, housing and public spaces to explicitly include the state’s transgender residents. HB 1319 was approved by a bipartisan vote of 14-10 and now heads to the Governor’s desk for his signature. The legislation passed the New Hampshire House with strong bipartisan support in March of this year. Today’s victory marks the first statewide proactive win on LGBTQ rights in any state since 2016, and comes on the heels of Anchorage, Alaska becoming the first American jurisdiction to uphold transgender protections on a standalone ballot measure.

Republican Governor Chris Sununu is expected to sign HB 1319 into law in the coming weeks. New Hampshire will become the 19th state in the country – and final state in New England – to explicitly provide comprehensive non-discrimination protections to LGBTQ people.

“Today, New Hampshire lawmakers showed tremendous leadership in support of the transgender community and their loved ones,” said Linds Jakows, campaign manager of Freedom New Hampshire, the bipartisan campaign working to pass the bill. “This law will go a long way to affirm the dignity of transgender people and allow them to truly live free. I want to especially thank my fellow transgender Granite Staters for their bravery and courage over the last few years – this victory would not have been possible without the voices of transgender people who have been telling their stories and educating lawmakers about the urgent need to make sure all Granite Staters are fully protected under the law. In a national landscape where transgender people are too often attacked for who they are, New Hampshire is a shining example for other states across the country. We look forward to the day Governor Sununu seals New Hampshire’s motto of Live Free or Die with his signature.”

“From coast to coast, the tides are turning toward freedom. New Hampshire’s transgender residents will rest easier tonight, knowing their elected leaders voted to affirm their dignity by passing comprehensive non-discrimination protections,” said Masen Davis, CEO of Freedom for All Americans. “Earlier this month, voters from all walks of life upheld transgender equality in a historic vote at the ballot in Anchorage, Alaska. Today I’m overjoyed to see the conservative New Hampshire legislature pass a comprehensive non-discrimination law that will make it that much easier for transgender Granite Staters to live their lives without fear. Freedom for All Americans is proud to have played a leadership role in both of these campaigns as we continue our work to secure full non-discrimination protections for LGBTQ people nationwide. Our shared triumph in New Hampshire is yet another example that equality is not a partisan issue, but a human issue – and one that resonates deeply with the core values of Americans from all walks of life.”

“Today the Senate passed common-sense legislation to ensure transgender people in our state are treated fairly and with dignity under the law,” said Devon Chaffee, Executive Director of the American Civil Liberties Union of New Hampshire. “It is passed time for New Hampshire to join the nineteen other states nationwide, including all other New England states, by explicitly including gender identity protections in our state’s non-discrimination protections.”

“Today, the New Hampshire Senate voted to affirm the dignity and humanity of transgender Granite Staters, and to ensure they have an equal opportunity to live and work free from discrimination,” said Janson Wu, Executive Director of GLBTQ Legal Advocates & Defenders (GLAD). “For more than a decade, transgender people across the state – along with family, friends, and freedom-loving allies – have spoken out, shared their stories, and led the fight to secure these critical protections. GLAD has been proud to be a partner in that work every step of the way. All Granite Staters can hold their heads high today, knowing that New Hampshire is truly embracing its ideals of freedom for all, and taking its place as a leader in the growing movement to secure equality across the nation.”

“No person should be fired, evicted, or denied service just because of who they are, and it is far beyond time that New Hampshire’s non-discrimination protections include transgender people,” said HRC National Field Director Marty Rouse. “Fair-minded people across the Granite State support these protections and recognize the importance of making New Hampshire an inclusive and welcoming state for all. Inclusive non-discrimination protections are now one step closer to becoming law, and we urge Governor Sununu to continue this momentum by signing HB 1319.”

HB 1319 was resoundingly endorsed by the Republican-majority New Hampshire House of Representatives, which passed HB 1319 on March 7th by a bipartisan vote of 195-129. Legislators in both chambers heard a combined twelve hours of testimony in support of the bill during three public hearings, most of which was from transgender Granite Staters who have experienced discrimination.

Freedom New Hampshire is the nonpartisan coalition of businesses large and small, law enforcement, anti-violence advocates, faith leaders, and transgender residents and their families working to introduce Granite Staters to their transgender neighbors and to make the case for equal opportunity and freedom from discrimination. The members of the nonpartisan Freedom New Hampshire coalition include Freedom for All Americans, GLBTQ Legal Advocates & Defenders (GLAD), the American Civil Liberties Union of New Hampshire (ACLU-NH), Human Rights Campaign, Transgender New Hampshire, and Rights and Democracy New Hampshire.

The bipartisan victory in New Hampshire comes as the Trump Administration continues to push an anti-transgender agenda at the federal level, targeting transgender youth, workers, and service members. A growing number of Americans are rejecting discrimination against transgender people, as evidenced by public outcry around North Carolina’s HB2; two consecutive failures by anti-LGBTQ activists in Washington State to bring the state’s decade-old non-discrimination law to a ballot measure; the defeat of Texas’ SB 6, one of the worst anti-transgender bills in the country; and the recent victory in Alaska where Anchorage became the first municipality to uphold transgender rights at the ballot.

Freedom New Hampshire has run a robust campaign since 2016 that features local New Hampshire residents who will be directly and positively impacted by passage of HB 1319, particularly transgender people and their families. In addition to New Hampshire’s Republican governor Chris Sununu’s support, HB 1319 has been endorsed by the New Hampshire Association of Chiefs of Police, the Business and Industry Association of New Hampshire, the New Hampshire Women’s Foundation, House Libertarian Caucus, Children’s Legislative Caucus, and the New Hampshire Human Rights Commission.

Governor Sununu is expected to sign HB 1319 in the coming weeks.

New Hampshire lawmakers vote to explicitly protect transgender people from discrimination

New Hampshire lawmakers vote to explicitly protect transgender people from discrimination

With today’s victory in the Senate, House Bill 1319 has passed both chambers of the New Hampshire legislature with bipartisan support

NEW YORK – GLAAD, the world’s largest LGBTQ media advocacy organization, released the following statement celebrating the New Hampshire Senate for passing HB 1319. House Bill 1319, also known as #TransBillNH, would update that state’s laws prohibiting discrimination in employment, housing, and public spaces to explicitly include transgender residents by adding protections on the basis of gender identity. It now heads to the governor with bipartisan support from both chambers of the state legislature.

“New Hampshire’s leaders are demonstrating that nondiscrimination protection is not – and should never be – a partisan issue. From Alaska to New Hampshire Republicans and Democrats are coming together to support all people,” said Zeke Stokes, Vice President of Programs at GLAAD. “Gov. Sununu has said he is inclined to sign the measure, and it’s critical that he do so in order to ensure that everyone in New Hampshire has access to the same freedoms and protections under law.”

Currently, New Hampshire is the only state in New England that has not passed transgender-inclusive non-discrimination protections. HB 1319 now heads to Republican Gov. Chris Sununu, who has previously indicated his support of the bill.

This legislative victory for transgender rights follows a victory at the ballot box last month where when voters in Anchorage, Alaska rejected Proposition 1, a sweeping anti-transgender ballot measure which aimed to overturn the trans-inclusive portions of the city’s 2015 nondiscrimination ordinance and require trans people to use public restrooms that correspond to their original birth certificate.

Liberty Counsel’s Mat Staver (you might know him  as Kim Davis’s attorney) is giddy about Trump’s judicial appointments and what they could do for conservatives, Right Wing Watch reports.

Said Staver: “The nice thing about what President Trump has done, different from other Republican presidents, is that he is appointing, he’s nominating, so far, judges who are what I would call constitutionalists, originalists, dedicated to the original understanding and interpretation of the Constitution and the statutes. On the other hand, Republican presidents in the past, they’ve been hit or miss. President Trump so far has been hitting this on the nail.”

Staver could hardly contain himself while talking to VCY America’s Jim Schneider about the possibility of “one, maybe two more” SCOTUS Justices retiring and being replaced “with someone like Gorsuch.”

Said Staver: “That means the abortion decision, the same-sex marriage decision, all of those things that went the wrong way will ultimately be in the balance to be reversed. So literally we are a few months away.”

“I have always been a mother – in all senses of the word, I like to think that I am a very nurturing person and pretty much looked after both physically and emotionally a lot of the children in my family when I was growing up – being the first grandchild always comes with an extra sense of responsibility – which was reinforced by the ways that the older members of my family. I stayed in this weirdly undefined position of responsibility till we moved to England and at that point, it was me caring for the physical and emotional wellbeing of my sisters. Although it was unexpected, being pregnant at 19 and having a baby at 20 I would say was smoother than I had been lead to believe it would be – in terms of motherhood I mean.

Society definitely has its ways of shaming individual decisions that do not necessarily fit in with the ‘average narrative’ and my journey through motherhood so far has been far from average.”

GLAAD responds to President Trump personally swearing in Mike Pompeo as secretary of state

GLAAD responds to President Trump personally swearing in Mike Pompeo as secretary of state

Family Research Council, the anti-LGBTQ hate group Pompeo has professional ties to, is holding an event called “Opportunities for Mike Pompeo” at the same time as the swearing in

NEW YORK – GLAAD, the world’s largest LGBTQ media advocacy organization, today responded to President Trump swearing in Mike Pompeo to be the next U.S. Secretary of State. Mike Pompeo has an extensive anti-LGBTQ record and professional ties to the Family Research Council, a Southern Poverty Law Center-designated anti-LGBTQ hate group.

“President Trump fired his Secretary of State over twitter then rammed through an unqualified replacement who has a consistent record of publicly espousing anti-LGBTQ views and professional ties to fringe anti-LGBTQ activist Tony Perkins,” said Sarah Kate Ellis, President and CEO of GLAAD. “Though it is unlikely that Mike Pompeo will prioritize LGBTQ rights in his role as Secretary of State, the fight for safety, equality, and acceptance at home and abroad will not be deterred by his personal anti-LGBTQ agenda or the Trump Administration’s continued attacks on marginalized communities.”

At the same time Mike Pompeo is being sworn in, the anti-LGBTQ hate group FRC, who Pompeo personally consulted during his time as CIA Director, is holding a panel discussion titled “Opportunities for Mike Pompeo.” This event includes Tony Perkins, who recently pushed to have support for the scientifically discredited “conversion therapy” in the 2016 Republican Party platform and Robert Destro who argues that LGBTQ non-discrimination protections are irrational.

Prior to Mike Pompeo’s April 12th committee hearing, GLAAD Campus Ambassador Tony Hernandez hand-delivered research Pompeo’s anti-LGBTQ record to the Senate offices of all 21 members of the U.S. Senate Committee on Foreign Relations urging them to question Pompeo to his anti-LGBTQ record. Sen. Booker, Sen. Shaheen, and Sen. Coons all heeded the call made sure that Pompeo’s anti-LGBTQ agenda was put on full display. During that hearing, Pompeo directly stated he opposes marriage equality and refused to denounce his past statements calling being LGBTQ a “perversion.”

Mike Pompeo’s anti-LGBTQ record goes far beyond his personal beliefs, Pompeo has worked closely with FRC which openly supported Uganda’s efforts to punish and execute LGBTQ citizens – known as the “Kill the Gays Bill,” promotes and defends the dangerous practice of conversion therapy, and actively opposed overturning laws that criminalize being gay.

Read more on Mike Pompeo’s extensive anti-LGBTQ record and ties to the designated hate group FRC via GLAAD’s Trump Accountably Project.

Mike Pompeo’s Connections to Family Research Council:

Consulted with Tony Perkins while serving as CIA Director: “Pompeo has consulted with Tony Perkins, president of the Family Research Council, an organization that the Southern Poverty Law Center has labeled an anti-gay hate group.” [The Washington Post; 8.24.17].

Has made (at least) six appearances on Family Research Council’s anti-LGBTQ radio show. Live with Tony Perkins: October 6, 2016; March 22, 2016; July 26, 2016; September 3; 2015; July 22, 2015; May 5, 2014.

Family Research Council endorsed Mike Pompeo during his re-election to the U.S. House in 2014, specifically citing his “support for marriage” and “traditional family values” as reasons behind their support: The culture has been challenged beyond all reasonable limits. The strong, conservative men and women elected in 2010 and 2012 need reinforcements…The votes you have cast on the life issue reflect your concern for mother and child and your support for marriage as between one man and one woman.” [Pompeo for Congress, 3.5.14]

One of thirty House of Representative members to join the Family Research Council on an amicus brief challenging the Affordable Care Act in the case National Federation of Independent Business v. Sebelius. [FRC; 10.27.11]

Anti-LGBTQ Record of the Family Research Council (FRC):

Actively lobbied against a congressional resolution denouncing Uganda’s “kill the gays bill:” “The blog Joe. My. God.,working with a reporter from Gay City News, reported that the conservative Family Research Council spent $25,000 “to lobby Congress against approving a resolution denouncing Uganda’s plan to execute homosexuals. The site posted three screencaps from the Family Research Council’s lobbying report; they suggest $25,000 was spent on lobbying what FRC described as “Res.1064Ugandan ResolutionPro-homosexual promotion.” [CBS News; 6.4.10]

Claimed the Ugandan bill that aimed to punish and execute LGBTQ people “upholds moral conduct:” The President [Obama] criticized Ugandan leaders for considering enhanced penalties for crimes related to homosexuality…The President said that “We may disagree about gay marriage, “but surely we can agree that it is unconscionable to target gays and lesbians for who they are.” Mr. President as long as you characterize efforts to uphold moral conduct that protects others and in particular the most vulnerable, as attacking people, civility will continue to evade us.” [Family Research Council via the Internet Archive; 2.4.10]

Opposed overturning Texas “Homosexual Conduct” law, which criminalized consensual sexual intimacy between same-sex couples: “To extend homosexual sodomy the same protections given to the marital union would undermine the definition of marriage and could open the door for homosexual marriage. The court should demonstrate judicial humility and decline to deconstruct in radical and revolutionary ways the bedrock social institution of marriage.’” [Family Research Council via the Internet Archive; 6.25.03]

Spent over $75,000 to lobby to keep “Don’t Ask Don’t Tell” in place: “The Traditional Values Coalition and the Family Research Council, have each spent more than $75,000 so far on their overall lobbying expenditures this year. Both groups support keeping the “Don’t Ask, Don’t Tell” policy in place.” [Open Secrets; 11.3.10]. Family Research Council President, Tony Perkins, also claimed there is “blood of young marines” on hands of legislators who voted to repeal Don’t Ask Don’t Tell. [YouTube, Right Wing Watch; 11.20.10]

Lobbied against LGBTQ-inclusive hate crimes legislation: “Social conservatives said the hate crimes bill would violate the First Amendment, and would be a step toward a larger gay rights agenda they oppose. ‘Expanding hate crimes puts America in lock step with the stated agenda of homosexual activists who will turn next to the so-called Employment Non-Discrimination Act, followed by the repeal of the ban on homosexuality in the military and then the Defense of Marriage Act,’ the Family Research Council warned on its Web site.” [The Washington Post; 10.23.09]

Printed and disturbed flyers defending the dangerous and discredited practice of conversion therapy: “Although much attention has been focused on counseling techniques or therapies for unwanted same-sex attractions and on the work of “ex-gay” ministries, there is startling evidence that considerable numbers of people experience significant change in some aspects of sexual orientation, particularly their behavior, quite spontaneously, without therapeutic intervention.”[Family Research Council via the Internet Archive; 7.5.10]

Testified in favor of anti-LGBTQ conversion therapy before legislative bodies in New Hampshire, Washington D.C., Maryland, Massachusetts, and Vermont: “Testimony by Peter Sprigg in Opposition to New Hampshire House Bill S. 587-FN” [Family Research Council; 2.21.17], “FRC’s Peter Sprigg Testifies before D.C. Council on Proposed Sexual Orientation Change Efforts Ban” [Family Research Council; 6.27.14], “FRC’s Peter Sprigg Testifies Before MD State House in Opposition to Bill Prohibiting Sexual Orientation Therapy for Minors” [Family Research Council; 3.2.18], “Family Research Council Expert Testifies Before Massachusetts General Court” [Family Research Council; 6.7.17], Testimony by Peter Sprigg in Opposition to Vermont Bill S. 132 [Family Research Council; 2.26.16]

Lobbied against the Employment Non-Discrimination Act (ENDA) proposed legislation that would prohibit discrimination in hiring and employment on the basis of sexual orientation or gender identity. [Open Secrets; bills FRC lobbied, 2013]

Mike Pompeo’s Personal Anti-LGBTQ Record:

Vowed to continue to fight against abortion, marriage equality, and related matters “each and every day:” As a Kansan, I hold a deep reverence for the sanctity of life, the solidarity of family, and the solemnity of marriage. I will continue the fight to uphold these fundamental ideals each and every day…I also fully support the traditional institution of marriage. Strong families are the most important building block of our Republic, and we must preserve them for the sake of our community and our culture. [Vote Smart; 1.1.13]

Insists families with same-sex parents are less “ideal”: “I think as you look back at civilization, look back at history, you find the strength of these families having a father and a mother is the ideal condition for childbearing,” Pompeo said. “Doesn’t mean there aren’t great families with single parents, great young men and women raised without either parent. If you’re asking for what is ideal, I think it’s being raised by a man and a woman.” [Vote Smart; 10.22.14]

Opposed the repeal of Don’t Ask Don’t Tell, suggesting that “when you enter the army you give up a few of your rights, there’s a few things that you can’t do that we get to do a civilians, so I would not a have supported that policy—or would.” [YouTube; September 23, 2010 District 4 Congressional Debate; 9.14.10]

Called the US Supreme Court’s 2015 ruling granting marriage equality to all fifty states as “a shocking abuse of power:” “Creating, out of nowhere, a federal right to marry, flies in the face of centuries of shared understanding of our Constitution,” Pompeo said in an email Friday. “It is a shocking abuse of power. It is wrong. I will continue to fight to protect our most sacred institutions; Kansans and our nation deserve no less.” [Vote Smart; 6.26.15]
