Openly gay former congressman Barney Frank went after deceased Supreme Court Justice Antonin Scalia on Tuesday while discussing Donald Trump’s tweets about flag burning.

Early on Tuesday, Donald Trump tweeted that flag burning should be illegal, ignoring the fact that it is constitutionally protected as free speech under the first amendment.

While on Hardball with Chris Matthews on Tuesday night, Frank referred to an opinion Scalia wrote that defended the legality of flag burning and proceeded to make a quip about the late Justice’s views on gay people.

Said Frank,

“Scalia wrote the opinion, he was very strongly on the other side of [flag burning], and [Trump] cited Scalia as his favorite justice. I think there was a pronunciation problem there. You know, Scalia was actually the leading advocate of fag burning, not flag burning.”

Chris Matthews replied, “That’s not funny,” while laughing. The rest of Matthews’ panel appeared taken aback by the remark.

Scalia once said if he were king, he “would not allow people to go around burning the American flag.”

“However,” the late Supreme Court Justice noted, “We have a First Amendment, which says that the right of free speech shall not be abridged — and it is addressed in particular to speech critical of the government.”

Gay New Hampshire Democratic Party Chair Ray Buckley is joining SC Democratic Party Chair Jaime Harrison, former Vermont Gov. Howard Dean, Minnesota Congressman Keith Ellison and former Maryland Gov. Martin O’Malley in the running for Democratic National Committee Chair, he announced on Facebook:

I’m in!

I am a candidate for Chair of the Democratic National Committee. I look forward to a robust discussion with you on the future of the Democratic Party and I ask for and hope to earn your support.

Make no mistake, if I am elected chair there will be radical reform of how the DNC operates. You and every member of the DNC will be called on to fully participate in the governance of our party. The DNC will be a team effort unlike what we have seen for many years. Every voice should be respected, every face reflected in the Democratic Party. The party cannot just be about winning the White House. We have thousands of other races, including state, county and local races, that we need to win as well.

In a series of tweets on Wednesday morning, Donald Trump said he is “leaving my great business in total” to focus on “running the country to MAKE AMERICA GREAT AGAIN” but he says he is doing it because it’s “visually important” and not legally required.

Said Trump: “I will be holding a major news conference in New York City with my children on December 15 to discuss the fact that I will be leaving my great business in total in order to fully focus on running the country in order to MAKE AMERICA GREAT AGAIN! While I am not mandated to do this under the law, I feel it is visually important, as President, to in no way have a conflict of interest with my various businesses.”

Unfortunately, Trump is wrong about the legal implications of staying tied to his business. It has been well-documented.

And at this point, does anyone believe him?

And Trump’s son-in-law Jared Kushner has conflicts of interest too:

The real-estate company controlled by Jared Kushner, President-elect Donald Trump’s son-in-law, has hundreds of millions of dollars in loans outstanding from domestic and foreign financial institutions, markets condominiums to wealthy U.S. and foreign buyers and has obtained development financing through a controversial U.S. program that sells green cards.

Those and other business activities could raise conflict-of-interest issues if Mr. Kushner is named to a staff position in the Trump administration. Executive branch employees are prohibited from participating in any matter in which there is “a close causal link” between that matter and a “real possibility” of a financial gain or loss, according to the U.S. Office of Government Ethics.
