Whole Foods Supervisor Who Said “Only Gay People Wear Crocs” Faces Discrimination Suit

According to a lawsuit filed Wednesday, a Whole Foods employee in Boulder, Colorado feels she faced ongoing discrimination due to her sexual orientation — all at the hands of a supervisor who made fun of her clothing, her Crocs in particular.

“She told me that I looked ‘unfuckable,’” Jennifer Johnston tells CBS4. “And that only gay people wear Crocs, which I took offense to.”

Johnston claims that when she complained to management, she was basically punished for doing so: the general manager wrote her up for playing music with “profane language,” which Johnston vehemently denies.

“It made me feel awful,” Johnston says. “I loved working for Whole Foods … it was really disappointing when I wasn’t supported back when I always supported them.”

She says the discrimination is what ultimately led her to resign. Now, she’s requesting back pay in addition to damages.

Whole Foods Market, which is currently investigating the incident, told CB4 in a statement that “discrimination in any form is unacceptable to Whole Foods Market. We were notified of this filing and are looking into the situation.”

Literally no one should be surprised that one of prominent Donald Trump supporter Peter Thiel’s companies employs hiring practices that are comparable to the sexual criteria of the worst douche nozzles on gay hook-up apps. The gay tech bazillionaire who brought down Gawker this summer and is rumored to be on Trump’s shortlist of possible supreme court nominees has a history of opposing diversity in hiring. In 2013, he co-authored a screed against Affirmative Action for Stanford Magazine, as well as a 1999 book decrying multiculturalism in higher education that drew criticism from former Secretary of State Condoleeza Rice, Stanford University’s then-provost.

Now the Department of Labor is suing Thiel’s troubled data-mining startup Palantir — which appears to be named after the evil crystal balls from The Lord of the Rings — for systematically discriminating against Asian applicants in its hiring practices.

According to the complaint, filed on Monday, Palantir hired only 11 Asian applicants compared to 14 non-Asians from a pool of 1,160 applicants, 85 percent of whom were Asian.

In a statement, the company denied the DoL’s allegations: “Despite repeated efforts to highlight the results of our hiring practices, the Department of Labor relies on a narrow and flawed statistical analysis relating to three job descriptions from 2010 to 2011.”

Earlier this year, Buzzfeed posted a deep dive into the secretive company based on internal documents that revealed it was hemorrhaging top clients. As of press time there has been no report yet on how fats and femmes fair at Palantir.

British vlogger Calum McSwiggan pleaded not guilty on Monday to filing a false police report and vandalism.

McSwiggan was charged by L.A. police after they reportedly found no evidence to corroborate McSwiggan’s claim that he was the victim of an anti-gay hate crime in June near popular West Hollywood gay nightclub The Abbey.

McSwiggan was in Los Angeles at the time for the annual VidCon social media conference.

On June 28, McSwiggan shared a photo of himself in the hospital appearing bruised and in bad shape, writing, “With three broken teeth and six stitches in my forehead, I’ve never felt so terrified to be a gay man in the public eye.” 

After police challenged his version of events, saying that McSwiggan inflicted injuries upon himself while in police custody and that he did not appear visibly bruised when they initially encountered him, McSwiggan released a more in-depth account of the night.

He admitted to having injured himself but insisted that he that he did not fabricate the assault. “Just because there were no visible marks on my face does not mean I was not attacked,” he said.

Police ended up officially charging him the day McSwiggan posted his photo to Instagram.

PREVIOUSLY: Gay Vlogger Calum McSwiggan Arrested for Vandalism, L.A. Sheriffs Dispute Claim of Attack

McSwiggan appeared at the Los Angeles Airport Courthouse to enter his pleas nearly three months to the day after his alleged assault.

The Telegraph reports: 

[McSwiggan] was ordered to return to the court for a pre-trial hearing on November 7 and refused to comment as he left the building.

After he was charged in June, Mr McSwiggan wrote on Facebook that he had caused the injury that required the stitches to his head but insisted he was attacked by three men.

The 26-year-old, who has more than 64,000 subscribers on YouTube, posted a photo on Instagram as he lay in a hospital bed after the alleged attack, telling his followers he suffered three broken teeth and required six stitches to his head.

The Los Angeles County Sheriff’s Department said officers investigated but were “unable to substantiate the assault”.

Though McSwiggan pleaded not guilty to vandalism, he previously admitted to damaging a car he alleges belonged to one of his assailants.

Said McSwiggan in a June Facebook post, “In a moment of devastation, anger and blind rage I kicked the wing mirror of the attacker’s car until it broke and then ripped it off with my hands. I also scratched the front of the car with the broken wing mirror before returning back to The Abbey for help.”

As for whether the alleged assault was a hate crime, McSwiggan said in June, “I can not say for 100% that this was because I was gay but I can’t think of any other justification for this random attack.”

Of the blowback he has received from those questioning the veracity of his statements, McSwiggan has said, “Being accused of being a liar and being called a disgrace to the LGBT+ community, a community I’ve dedicated my life to, is more painful than any hate crime could ever be.”

Trevor Noah provided a recap last night of the first presidential debate between Hillary Clinton and Donald Trump, or as he called it, ‘the real life version of Twitter.’

Noah called out what he saw as the first lie of the evening — Hillary saying “Donald, it’s good to be with you” — and also commented on many of the night’s most talked about moments.

Referring to Trump’s bragging about not paying taxes, Noah joked, “Yeah, you know who else found a way around the rules? OJ. No one likes him.”

Of Hillary’s shimmy, Noah quipped that the former Secretary of State felt compelled to dance because she was in her domain–the domain of words.

As for Trump’s sniffling, Noah, like many others, had a theory as to what that might be about.
