Eric Fanning, First Openly Gay U.S. Army Secretary, Sworn In: WATCH
Eric Fanning was sworn in today as Secretary of the U.S. Army, the first openly gay man to hold the position.
Fanning’s confirmation yesterday followed months of stonewalling by Senate Republicans who had been making demands of President Obama regarding detainees at Guantanamo Bay.
“It has been a long process to get here, one that I don’t think even the writers from ‘House of Cards’ could have scripted if they tried,” Fanning said after the swearing in, calling his appointment “a tremendous honor.”
Defense Secretary Ashton Carter said Fanning “embodies the kind of strong and steady leadership and civilian commitment to our men and women in uniform that have made our military the finest fighting force the world has ever known.”

Tennessee Special Session Targeting Transgender Students Would be Expensive Failure in Leadership
Today, HRC released the following statement after news reports emerged today that lawmakers in Tennessee are considering a special session in order to target transgender students and write discrimination into state law.
“Tennessee lawmakers should learn the lessons of what happened in North Carolina, where dangerous and shameful attempts to target transgender students have harmed countless North Carolinians, done millions of dollars of economic damage to the state, damaged the state’s reputation, and cost jobs,” said HRC Communications Director Jay Brown. “Tennessee lawmakers who go down this road are gambling with the lives and safety of real people and their economy. The hateful bill that passed North Carolina has drawn opposition from hundreds of major employers who have said that putting transgender people at risk for discrimination is not just wrong, but bad for business.”
In North Carolina, 200 companies have spoken out and demanded the repeal of HB2, which discriminates against transgender students and forces them to use restrooms inconsistent with their gender identity. Since North Carolina Gov. Pat McCrory signed HB2 into law, the state has lost at least 1750 jobs and suffered millions of dollars in economic damage.
There is bipartisan opposition to laws that target transgender people. South Dakota’s Republican Gov. Dennis Daugaard vetoed a bill earlier this year that targeted transgender students for discrimination. A CNN/ORC poll recently found 6 in 10 people oppose laws like North Carolina’s HB2, which discriminates against transgender people. Tennessee Gov. Haslam also previously spoke out against anti-transgender bills in the state.
One academic study this year found that restricting restrooms for transgender teens correlates with a high suicide rate. Similarly, another study this year found that transgender youth who are allowed to express their gender identity have good mental health outcomes.
Already, 18 states and the District of Columbia have laws on the books allowing transgender people equal protections and the ability to use the restroom that matches their gender identity. More than 75 percent of Fortune 500 companies have adopted similar policies and continued to function without the costly creation of new facilities or disruption of their businesses.
Multiple fact checkers have found that there have been no recorded examples of public safety incidents from these policies.
Last week, the U.S. Departments of Justice and Education issued guidance for school districts to ensure transgender students are treated with dignity in public and federally-funded schools, including having equal access to restrooms and locker rooms consistent with their gender identity. While this guidance is consistent with previous guidelines and enforcement by the Departments, the treatment of transgender students has become national issue following the recent passage of the discriminatory HB2 law in North Carolina. Among its shameful provisions, HB2 prohibits public school students from using restrooms and other school facilities consistent with their gender identity.
For several years, the U.S. Departments of Education and Justice have been interpreting and enforcing Title IX of the Education Amendments of 1972 to prohibit discrimination on the basis of gender identity or sex stereotyping as unlawful sex discrimination. Additionally the U.S. Court of Appeals for the 4th Circuit recently upheld the Department of Education’s assertion that the nation’s civil rights laws protect transgender students from discrimination, including in the provision of bathrooms.

Rapper Malka Red Accidentally Creates Gay Anthem With Her Single ‘Boy Booty’
“Well, I guess…boy booty is…OK,” says the character of Malka Red’s reluctant friend towards the end of the rapper’s video for her aptly named song “Boy Booty.”
The video, which has been steadily racking up views since it was released earlier this month, centers around the almighty boy booty, and while it takes Malka some time (and ample booty) to get her friend to come around on the topic, gay men certainly don’t need any nudging.

In an email to Queerty, Malka writes, “It’s a response to sexism I’ve experienced in the music industry, and it’s also been a hit within the gay community. A friend told me I had ‘accidentally created a gay anthem.’”
Accident or not, we’ve long held that men deserve a little objectification every now and then. Call it a leveling of the playing field, or just call it hot.
Malka likes boy butt and she cannot lie; we’re with her.

Prop. 8 Lawyer Ted Olson Joins Legal Fight Against North Carolina’s ‘Bathroom Bill’
Prop. 8 lawyer Ted Olson has joined the Human Rights Campaign in their legal effort to support the Department of Justice’s lawsuit against North Carolina’s discriminatory bathroom bill, HB 2.
HRC announced on Wednesday that Olson will write an amicus or ‘friend of the Court’ brief in support of the DOJ’s suit.
U.S. Attorney General Loretta Lynch last week announced the lawsuit against North Carolina and Governor Pat McCrory for violating the rights of transgender citizens.
Olson, who previously served as the U.S. solicitor general under George W. Bush, has argued dozens of cases in front of the Supreme Court. The conservative lawyer became an unexpected ally of the left when he took up the case against Prop 8, the California ballot measure banning same-sex marriages, in 2009. The case eventually reached the Supreme Court in 2013, when the justices upheld a lower court’s decision to overturn the ban.
“HB2 discriminates against fellow citizens because of who they are,” Olson said in a statement. “This law directly challenges the legitimacy of the identity of transgender persons and then compels them to deny it every time they use a public restroom. There can be no doubt that this is bad for business in North Carolina.”
HRC President Chad Griffin said in a statement,
“HB 2 is a hateful piece of legislation that has not only harmed thousands of people across North Carolina, but hurt companies and damaged the state’s economy. We are proud that Ted Olson, one of the nation’s leading conservative legal minds, will lead a brief on behalf of the business community and advocate for the equal rights and dignity of transgender Americans.”
