Jeb Bush might be “fine” with transgender people serving openly in the military (as long as it doesn’t affect morale), but Scott Walker is trying to stake out a more hardline social conservative stance this election.

Asked by Newsmax host J.D. Hayworth what his position on transgender (and gays and lesbians) serving in armed forces, Walker responded that he “wouldn’t change” the military’s policy and would instead focus on giving the military the “resources” needed to win wars.

Openly gay Fox News contributor and Townhall.com editor Guy Benson had some things to say about the modern-day gay rights movement while at Erick Erickson’s RedState conservative gathering on Saturday.

Benson, who came out as gay in a footnote in his new book End of Discussion: How the Left’s Outrage Industry Shuts Down Debate, Manipulates Voters, and Makes America Less Free (and Fun), condemned the fight against Christian-run businesses who refuse to serve same-sex couples for religious reasons.

“One of the reasons we think the gay rights movement has been successful in really shifting public opinion massively on the question of same-sex marriage is they’ve made lots of appeals to sort of Americans’ libertarian sense of fairness. Live and let live. Our marriage doesn’t affect you. Lets be fair. And people were like “Yeah, that’s reasonable.” What made us concerned is how it seems like as soon as they have the upper hand in political opinion, public opinion all of the sudden the rules change. It was no longer live and let live. It was, bake us a cake or else. Celebrate us – it’s mandatory – or we’re going to destroy you. And that’s not what real freedom looks like.”

Benson’s End of Discussion co-author Mary Katharine Ham was also on stage during the talk and revealed the decision to write the book came about after watching the Brendan Eich controversy back in 2014.

At the time that Brendan Eich was found out for this thought crime [supporting Proposition 8], it was enough to make him lose his job. He was hounded out of his job not because he treated anyone badly in the workplace or discriminating against anyone…And we said hey, if you can’t hold a mainstream opinion, political opinion in American society with which the Left and its activists disagree and also hold your job, how free is your speech?

Transgender Inmate Will Likely Get Parole Instead Of Court-Ordered Surgery

 SACRAMENTO, Calif. (AP) — Gov. Jerry Brown is allowing parole for a transgender inmate who is trying to force California to become the first state to pay for sex reassignment surgery.

A federal judge in April ordered the state to provide the surgery, which had been scheduled for July. It was delayed after the state appealed.

The governor’s office said Friday that Brown was taking no action on the Board of Parole Hearings’ recommendation to release Michelle-Lael Norsworthy, which means her parole will proceed.

The decision makes it less likely that the 51-year-old will be able to have surgery funded by the prison before she is released. Parole board spokesman Luis Patino said it usually takes about a week for an inmate to be released after the governor allows a parole to proceed.

Brown decided Norsworthy is no longer dangerous, 30 years after she fatally shot Franklin Gordon Liefer Jr., 26, following an argument in a Fullerton bar in November 1985.

Norsworthy, then 21, was convicted of second-degree murder after she shot Liefer three times. He died six weeks later.

She is being held at Mule Creek State Prison, a men’s prison in Ione, near Sacramento. Prison records refer to her by her birth name of Jeffrey Bryan Norsworthy, though she has lived as a woman since the 1990s.

She was diagnosed with gender identity disorder in 1999 and began taking female hormones. She began asking the corrections department for the surgery in 2012 after learning a judge for the first time had ordered Massachusetts to provide an inmate with the procedure. However, that decision was overturned on appeal in December, and the U.S. Supreme Court declined to intervene.

The 9th Circuit agreed to hear California’s appeal of U.S. District Judge Jon Tigar’s ruling and a hearing is scheduled for Thursday. The appellate court noted that the case raises serious legal questions about whether denying the surgery violates Norsworthy’s constitutional rights against cruel and unusual punishment.-

 

The California Department of Corrections and Rehabilitation says it has met all of its legal requirements by providing Norsworthy with counseling and hormone therapy.

The state filed paperwork in federal court Friday saying it has agreed to provide sex reassignment surgery for another inmate, Shiloh Quine, 56, to settle a separate lawsuit.

“CDCR evaluates every case individually, and in the Quine case, every medical doctor and mental health clinician who has reviewed this case, including two independent mental health experts, determined that this surgery is medically necessary for Quine,” corrections department spokesman Jeffrey Callison said in an emailed statement.

Quine, formerly known as Rodney James Quine, is serving a life sentence for murder, kidnapping and robbery.

Norsworthy testified at her parole hearing in May that she accepts responsibility for her crime. She said at the time, she was “pretty much drinking every day all day” but is now sober and attends Alcoholics Anonymous meetings in prison.

She said she also takes steps to control her anger and make better judgments.

Texas Attorney General Ken Paxton wants a federal judge to cancel a hearing on whether he should be held in contempt of court for resisting the U.S. Supreme Court’s ruling in favor of same-sex marriage.

And despite the possibility of being held in contempt, Paxton’s office continues to defy the high court’s decision in Obergefell v. Hodges, according to Lambda Legal.

Texas coupleAs we mentioned last week, U.S. District Judge Orlando L. Garcia has ordered state officials to issue an amended death certificate to a gay man (right) whose husband died earlier this year. The amended death certificate was issued a day later.

Garcia also ordered Paxton to appear in court on Wednesday to explain why he shouldn’t be held in contempt over the state’s refusal to issue the amended death certificate for 40 days after the high court’s decision. Now, Lambda Legal says state officials continue to deny accurate birth certificates to same-sex couples, and another gay widower says he still hasn’t received and accurate death certificate despite repeated requests.

A same-sex couple that was denied an accurate birth certificate, as well as the widower who still hasn’t received an accurate death certificate, are expected to join the contempt hearing in San Antonio this week to testify against Paxton. The Texas Observer reports:

Ken Upton Jr., senior counsel for the LGBT civil rights group Lambda Legal, wrote in a letter to U.S. District Judge Orlando Garcia today that the Department of State Health Services continues to deny accurate birth certificates to the children of same-sex couples.

Upton and his clients, Susan Leigh Jorgensen and Robin Bass Jorgensen, plan to attend a hearing next week on a contempt motion against Paxton and Kirk Cole, the interim health department commissioner, over their refusal to issue an amended death certificate to John Stone-Hoskins listing him as the husband of James Stone-Hoskins. James Stone-Hoskins died in January after the couple married in New Mexico last year. …

“While it appears the defendants have issued the specific corrected death certificate you ordered, they are by no means complying with the permanent injunction you entered against them in this matter,” Upton wrote in his letter to Garcia, adding that the state health agency has “steadfastly refused” to do so.

Paxton’s office responded to Garcia’s order by filing an 11-page motion asking the judge to cancel the contempt hearing since the state has finally issued an amended death certificate to one gay widower. In the motion, Paxton’s office argues it’s unclear whether the high court’s ruling should apply retroactively to death certificates:

“The Attorney General has not refused to amend any death certificate,” the 11-page motion states. “Instead, he is providing legal advice and representation to a client who has preferred to seek court guidance on whether Obergefell retroactively requires that he take action that will significantly impact settled proceedings. There is absolutely no authority for the proposition that a constitutional officer of a State may be held in contempt for good-faith representation of a client in discharging his constitutional duty.”

Regardless of whether Paxton is held in contempt, the state will almost certainly be on the hook for attorneys’ fees in the cases. But the contempt hearing may ultimately be the least of Paxton’s worries. He’s also facing up to life in prison for three felony charges related to alleged securities fraud.
Despite anti-gay rhetoric from Paxton and others, state government largely complied with the high court’s ruling initially, extending benefits to the same-sex spouses of employees and conceding lawsuits related to gay marriage. But now Texas is suddenly bucking.
It’s possible Paxton is responding to pressure he’s received from right-wing activists to resist ruling. It’s also possible he’s trying to divert attention from the securities fraud charges and pander to his tea party base — which may be the only faction that continues to support him as he faces a criminal trial.

Sydney marches for marriage equality

A march took place on Saturday calling for the government to legalize gay marriage.

The march comes three days before it is believed a cross-party marriage equality bill will be lodged in the Australian parliament (August 11).

More than 2000 people marched Sydney town hall before chalking rainbow colours into the street at the intersection of Flinders Street in Darlinghurst.

Yesterday Brisbane held a rally for marriage with around 6000 taking part.

The rally coincides with two other prominent pro-marriage equality initiatives.

In the capital of Australia, Canberra, the airport has been lit in rainbow colours to greet MPs returning from their winter break.

A TV campaign has been launched which features a number of videos showing Australians sharing their support for marriage equality. The videos have been listed on the website: www.wecandothis.org.au/.
The national director for the Australian Marriage Equality, Rodney Croome said: ‘The ad highlights the key values behind marriage equality: love, commitment, family and fairness.”

‘Support for marriage equality has never been stronger and with the cross-party bill to be introduced this week we have never had a better chance to achieve the reform.’
